Workman's comp - elevator injury Cindy71 01/16/03
    I got injured at work about 3 months ago and ended up filing a claim. I've seen a chiropractor about 4-5 times, she referred me to a masseuse, which helped relieve the pain for 2-3 days. After a couple months, she then suggested I see an orthopedic specialist. During this whole time, Workman's comp. okayed every visit. The orthopedic doctor referred me to physical therapy 3 times a week for 6 weeks. Each session is about 2 hours (all taken after work ours). The only time I have taken off any time related to this accident was when I had to schedule a doctor's appointment in the middle of my day.

    My workmans comp agent is very short with me and doesn't seem to care how or what's going on. I've asked her boss if I can get another agent, to no avail. Just yesterday I had to take off a day of work because workmans comp scheduled me to see an IME in the middle of the day. The doctor wasn't as bad as I thought, but he did say that I have an injury, but he doubts it happened at work. He suggested that I may have gotten hurt while playing some kind of sport (which I didn't). He also said he is going to suggest that my massage therapy stop.

    I don't feel very comfortable speaking to my HR rep. because her advice when I first went to her was that I must have walked into the elevator wrong.

    I work for a pretty big company, but each department has their own HR Rep. so I have no choice but to go thru her.

    My question is, who should be on my side? I feel both my workmans comp rep is looking to screw me (never returns my calls or my physical therapists calls) as well as my own HR Rep.

    I really don't want to have to get a lawyer, but I don't know who to turn to.

    What are my rights? Shouldn't someone be on my side?

    If workmans comp agreed to pay for the masseuse, can they turn around at any time and reject the bill (as the IME doctor suggested they may do)?
