Noise Pollution ?? ROLCAM 05/25/05
    What rights do residents living next to main roads have, to reduce or if possible eliminate noise pollution caused by light and heavy vehicles? Is the government obliged to install noise absorbers along the roads?

      That depends (I did not say this process is easy .I have spent years battling to get things done in local politics ) ;I have seen both instances . To be honest it helps if the person complaining has a friend on the town board or is a friend of someone who has influence. There are alot of factors. I know someone who was able to keep a waste /refuse collecting company from firing up their trucks before 7 AM .But sometimes the threat of losing business scares town officials.

      Also ;many of the roads are State controlled .That is a much tougher nut to crack . NY State Dept of Highways is a terrible organization to do any business with. My town has been trying for years to get a 4 way traffic light on a hazardous intersection and the big tie-up is that one of the roads is not an officially road yet . The road is an entrance into a municipal park ,and there is a flow of minors ,and other pedestrian crossing this State Highway to get to the park (two ball fields ;soccer fields ;play grounds ;and a roller hockey rink with lights for evening games).The traffic light controls already there controls traffic on the State Highway and one side street .But the State refuses to make the 4th side of the traffic light operational .It is insane ! People coming out of the park do not know if highway travelers have a green or red light. Negotiations for this simple remediation have gone on far too long (The town doesn't officially own the road going into the park so it has no right to "dedicate" the road even though the town provides all the maintainance .
      Back to NY State Dept. Highways. Noise remediation does happen but it seems like work procedes at a snails pace. Many populated sections of the NY Thruway still do not have noise barriers constructed yet even though the Thruway went past my area in the 1950s . It seems they pawn these barriers off like they are political favor chips .
