When is a much tougher question .He is "credited "with saying that in a speech in 1761 while arguing against the Writs of Assistance which allowed officials to get warrants to examine for smuggled goods.Much of his speech is not remembered verbadum and was summarized by John Adams. This part of it is considered authentic :

1761 - James Otis, born in Mass. Known for his famous challenge to the British -imposed writs of assistance- general search warrants designed to enforce more strictly the trade and navigation laws in North America. At this time he also reportedly coined the euphonious, oft-quoted phrase, " Taxation without representation is tyranny." He was chosen as speaker of the house in 1766.
