i hope someone can answer this. My 17 year old nephew was driving a car he borrowed from his girlfriend's father and got into an accident that he was not at fault. Here is the tricky part.
he does not have a liscence yet, only driver's permit. His girlfriend was in the car but she has no liscence and is 17 yrs old too. A third passanger was in the car and is an adult but has a drive's liscence from another state. What will happen to him and the might happen top the owner of the car? Fine? denied his liscence? |

First it will depend on the specific law of your state, since many states have all sorts of various laws on learners permit.
Normally the permit driver has to have an adult (someone over 18) who has a valid licence It would not matter where the licence was from, as long as it was valid. Now some states may require the adult to be in the front seat, others it may have to be a family member.
If he did not get a ticket at the scene most likely he will not get one at all.
Now on fault, it may be the other drivers fault, but does the other driver have insurance, and if so, is it going to pay.
As the driver, if the other parties insurance does not pay, the car owner can look at him for payment also if the at falut driver can not or does not pay.
If he is fined for driving without a valid licence, or perhaps violating his learners permit, many states will void his learners permit and not allow him to even apply for a licence for one year. If he is given a ticket, he should hire a local traffic attorney to represent him in court, |
